According to Oneida County Sheriff’s Office Chief Deputy Derrick O'Meara, who is the Director of the Oneida County Child Advocacy Center, a Rome man has been arrested after being indicted by the Oneida County Grand Jury for having sexual contact with an underage female child.

On January 23, 2020, Utica Police Investigator Fred Bruzzese, who was assigned to the Child Advocacy Center, began the investigation where allegations were reported that David Smith, age 40, had been sexually abusing a female child under the age of 15.

During the investigation, it was learned that Smith had sexually abused the victim from the age of 4 to the age of 13. Enough evidence and corroboration was obtained to submit the case to the Oneida County Grand Jury for review.

The Grand Jury received this case during the week of September 7th, 2020, and Smith was Indicted on Friday, September 11, 2020, for the charges of Predatory Sexual Assault of a Child, a Class A-II Felony, Course of Sexual Abuse of a Child, a Class B Felony, Rape in the 2nd Degree, a Class D Felony, and 2 counts of Endangering the Welfare of a Child, which are Class A Misdemeanors.

After the indictment was passed down from the Grand Jury, an Arrest Warrant was issued for Smith on the previously listed charges.

On Monday, September 14, 2020, members of the Oneida County Sheriff’s Office Warrants Unit, along with members of the New York/New Jersey Regional Task Force, located Smith and arrested him without incident.

Smith was transported to the Oneida County Sheriff’s Office where he was processed, and then transported to Oneida County Court where he was arraigned on the charges against him.

At arraignment, Smith was remanded to the Oneida County Correctional Facility in lieu of $25,000 cash bail, $50,000 bond.

An Order of Protection has been requested on behalf of the child and services have been offered through the Child Advocacy Center.
