According to Oneida County Sheriff, Robert Maciol; On May 12, 2022, at about 0754 AM, Deputies responded to State Route 49 EB near the Cavanaugh Rd exit in the Town of Marcy for a reported two car property damage motor vehicle accident. Deputies were preparing to assist the New York State Department of Transportation in the construction zone on Route 49 as part of Operation Hard Hat when the accident was reported to be involving a NYSDOT vehicle.

Upon arrival, Deputies determined that Suzanne Brayman (75), of Rome, NY, was operating a grey 2010 Chrysler minivan Eastbound on Route 49 in the driving lane and failed to move over for NYSDOT vehicles setting up the active construction zone with flashing amber lights activated and construction area signage displayed prior to the accident location. Due to failure to move over for hazard vehicles and speed not reasonable and prudent, Brayman’s vehicle struck the “impact attenuator” attached to a 2020 International NYSDOT dump truck, which was parked partially in the driving lane and on the southern shoulder of the roadway, on the driver side rear corner with the front end of her vehicle before coming to rest.

Brayman and her front seat passenger Courtney Leaman (31), of Rome, NY, were evaluated on scene and released without injury. Brayman was issued citations for “Failure To Use Due Care for a Hazard Vehicle” and “Speed Not Reasonable and Prudent” returnable to Marcy Town Court at a later date.

The Oneida County Sheriff's Office were assisted on scene by Maynard Fire Department, Kunkel Ambulance, and the New York State Department of Transportation.

At the conclusion of Operation Hard Hat with the NYSDOT, Deputies issued a total of 14 traffic citations for violations including Operating a Motor Vehicle While Using a Cellphone/Electronic Handheld Device, Failure to Move Over For Emergency Vehicles/Hazard Vehicles, Speed Violations, and Unlicensed Operation.
