According to Oneida County Sheriff, Robert M. Maciol deputies responded to a MVA car/ bicycle on State Route 233 in the Town of Westmoreland at around 7:55 PM. Benjamin David, 59 of New Hartford was riding a bicycle southbound on Route 233 when he entered the roadway from the shoulder. The driver of the vehicle, Javante Brill' Rollins, 16 of Rome was operating a 2002 Honda Civic southbound when he struck Benjamin David.

Benjamin David was transported by COCVAC ambulance to St. Elizabeth's Hospital for severe but non life threatening injuries. Brill' Rollins was evaluated at the scene by Westmoreland Fire Department. The crash is being investigated by the Criminal Investigations Unit, the Forensic ID Unit, and was reconstructed by the Accident Reconstruction Unit.
