Oneida County Sheriff’s Office Chief Deputy Derrick O’Meara, Director of the Oneida County Child Advocacy Center, announces the arrest of David Giacona, age 40 of the Town of Whitestown. Giacona, who is a Level 3 Registered Sex Offender, was arrested by OCSO Sergeant Melissa Bolton on 10/27/22, for failing to meet his obligations as a registered sex offender under the Sex Offender Registry Act.

Under SORA, Level 3 Registered Sex Offenders are required to personally appear at the local law enforcement agency having jurisdiction, every year, for the purpose of providing a current photograph. Giacona failed to meet this requirement and as a result, was charged with one count of Failure to Provide an Updated Photograph, a Class E Felony under the NYS Corrections Law. Also, under SORA, Level 3 Registered Sex Offenders are required to personally verify their address with the local law enforcement agency having jurisdiction, every ninety calendar days. Giacona failed to meet this requirement and as a result, was charged with one count of Failure to Verify Address/90-Day Verification-First Offense, a Class E Felony, under the NYS Corrections Law.

Giacona was held at the Oneida County Correctional Facility pending arraignment on this date at Centralized Arraignment Court.
