A homeless man is arrested for attempted murder and assault.

According to Oneida County Sheriff Robert Maciol, Sheriff's deputies were called to Route 49 in Marcy, between the Route 291 and River Road exits, at about 6:00 AM on May 21st for an injured man walking in the roadway. The man was taken to St. Elizabeth's Hospital where he was treated for cuts to his head.

Members of the Sheriff's forensic unit and criminal investigation unit were called in to assist deputies. Sheriff's Investigators arrested 32 year old Henry Estuardo Castaneda, who says that he is homeless. Sheriff Maciol said that the victim and Castaneda were acquaintances.

As Castaneda was driving on Route 49 the victim began to use disparaging remarks which enraged Castaneda. Castaneda pulled over and the two got out of the car. Castaneda then pushed the victim to the ground, choked him, and repeatedly struck him in the head with a beer bottle.

Castaneda was charged with attempted murder in the second degree and assault in the second degree, both felonies. He is being held in the Oneida County Correctional Facility awaiting arraignment.
