According to Oneida County Sheriff Robert Maciol, a Rome woman was arrested for Felony DWI after crashing her vehicle with a 12 year old child passenger.

On May 19th, 2024 at around 5:15 pm, Deputies were dispatched to a property damage motor vehicle accident on Gifford Road in the Town of Vernon. Deputies determined that Michelle Malone, age 32 of Rome, backed into a field causing damage to her vehicle. Malone had a 12 year old child passenger in the vehicle at the time of the accident. After an investigation, Deputies determined that Malone was intoxicated and took her into custody. Malone was found to have a .26 blood alcohol content, which is over three times the legal limit in the State of New York. Malone was ultimately charged with Driving While Intoxicated (common law), Driving While Intoxicated (0.08 or higher BAC), Aggravated Driving While Intoxicated (0.18 or higher BAC), Felony Aggravated Driving While Intoxicated (child less than 15 years of age in the vehicle, also known as "Leandra's Law"), Endangering the Welfare of a Child (Class A Misdemeanor), as well as four separate traffic violations.

Malone was transported to the Kurt B. Wyman Law Enforcement Building for processing, where she was released on her own recognizance after Centralized Arraignment. An order of protection was issued on behalf of the 12 year old child, and Child Protective Services were notified. Fortunately, there were no injuries as a result of the accident, and the child was turned over to a sober relative.
