According to Oneida County Sheriff, Robert M. Maciol the Oneida County Grand Jury has indicted Richard J. Burdick Jr. for Aggravated Vehicle Homicide, a class B Felony. The charge stems from an MVA that members of the patrol division were dispatched to on December 22nd, 2019. Richard J. Burdick Jr. was operating his 2006 GMC Sierra pick-up truck northbound on State Route 12b in the Town of Kirkland. The passengers inside of Burdick's vehicle were; Kelly Gell, 44, Lawrence Gell, 57 and Quinton Gell, 23 all from Clinton. Burdick Jr's vehicle struck a 2012 Honda Civic traveling southbound being operated by David Pearsall, 66 of Morrisville and his passenger Lorie Pearsall, 66 also of Morrisville. David Pearsall was pronounced deceased on scene and Lorie was transported to the hospital for her injuries. The crash was reconstructed by the Sheriff's Office Forensic Identification Unit. The Criminal Investigation Unit investigated the crash along with members of the Patrol Division. Burdick Jr's BAC was determined to be higher than .18%.

Burdick Jr. was captured by members of the Sheriff's Office Warrants Unit.
